1.قبول الشروط

By accessing or using the Qawaid platform, APIs, documentation, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. We recommend that you read these Terms carefully before using the platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Qawaid ("Qawaid", "we", "us", or "our").

2.وصف الخدمة

Qawaid is a cloud-based rule engine platform that enables organizations to create, manage, test, and deploy business validation rules and decision tables. The Service includes:

Rule Management: Creation, editing, versioning, and deployment of validation rules through a visual interface and REST/gRPC APIs.
Decision Tables: Configuration and management of decision tables for complex business logic.
Evaluation Engine: Real-time rule evaluation via API endpoints with support for multi-tenant workloads.
Analytics Dashboard: Monitoring, reporting, and insights into rule evaluation performance and outcomes.
Team Collaboration: Role-based access control, approval workflows, and audit logging for team environments.
Vertical Packs: Industry-specific rule templates and configurations for accelerated deployment.

The specific features available to you depend on your subscription plan. We reserve the right to modify, add, or remove features with reasonable notice.

3.تسجيل الحساب

To access the Service, you must create an account by providing accurate and complete registration information. You are responsible for:

Account Security: Maintaining the confidentiality of your login credentials and all activity that occurs under your account. You must notify us immediately of any unauthorized use.
Accurate Information: Keeping your account information up to date and accurate at all times.
Age Requirement: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account.
One Account Per Person: Each individual user should have a unique account. Sharing login credentials among multiple individuals is prohibited unless using team member seats.

We reserve the right to suspend or terminate accounts that violate these requirements or that we reasonably believe are being used fraudulently.

4.الاشتراك والفوترة

Qawaid offers multiple subscription tiers (Free, Starter, Professional, and Enterprise). By subscribing to a paid plan, you agree to the following:

Billing Cycle: Paid subscriptions are billed in advance on a monthly or annual basis, depending on your selection. Annual subscriptions receive a 20% discount.
Payment Method: You must provide a valid payment method. All fees are charged automatically. Failure to pay may result in service suspension.
Price Changes: We may adjust pricing with at least 30 days prior written notice. Price changes take effect at the start of your next billing cycle.
Refunds: Monthly subscriptions are non-refundable. Annual subscriptions are eligible for a prorated refund within the first 30 days of the billing period.
Taxes: All prices are exclusive of applicable taxes. You are responsible for any taxes, duties, or levies imposed by your jurisdiction.
Usage Limits: Each plan includes specific limits on rules, decision tables, evaluations, and team members. Exceeding limits may result in reduced service throughput until you upgrade.
Free Tier: The Free tier is provided at no cost with limited features. We reserve the right to modify Free tier limits at any time with reasonable notice.

5.سياسة الاستخدام المقبول

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

Use the Service to process, store, or transmit any data that violates applicable laws or regulations.
Attempt to gain unauthorized access to the Service, other accounts, or related systems or networks.
Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
Use the Service to build a competing product or reverse-engineer any aspect of the platform.
Exceed your plan's usage limits through automated means designed to circumvent rate limiting.
Use the Service to process data subject to specific regulatory frameworks (e.g., HIPAA, PCI-DSS) unless you are on an Enterprise plan with the appropriate compliance add-on.
Upload or transmit malicious code, viruses, or any material that could damage or impair the Service.

Violation of this policy may result in immediate suspension or termination of your account without refund.

6.ملكية البيانات

We believe your data belongs to you. The following clarifies ownership and rights:

Your Data: All rules, decision tables, configurations, evaluation data, and content you create or upload to the Service ("Customer Data") remain your property. We claim no ownership over Customer Data.
License to Us: You grant Qawaid a limited, non-exclusive license to use, process, and store Customer Data solely for the purpose of providing and improving the Service.
Data Portability: You may export your Customer Data at any time using our API or built-in export features. Upon account termination, we will make your data available for export for 30 days.
Aggregated Data: We may use anonymized, aggregated data derived from your use of the Service for analytics, benchmarking, and product improvement. Such data will not identify you or your organization.

7.الملكية الفكرية

The Qawaid platform, including its software, designs, documentation, APIs, trademarks, and all related intellectual property, is owned by Qawaid and protected by applicable intellectual property laws.

Limited License: We grant you a non-exclusive, non-transferable, revocable license to access and use the Service in accordance with your subscription plan and these Terms.
Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you decompile or reverse-engineer the software, unless permitted by applicable law.
Feedback: If you provide suggestions, ideas, or feedback about the Service, you grant us a royalty-free, worldwide, perpetual license to use and incorporate such feedback without obligation to you.
Open Source: Certain components of the Service may incorporate open-source software, which is subject to its respective license terms.

8.اتفاقية مستوى الخدمة

Qawaid commits to the following service level targets based on your subscription plan:

Free Tier: No uptime guarantee. Service is provided on a best-effort basis.
Starter: 99% monthly uptime. Maximum 7.3 hours of downtime per month.
Professional: 99.9% monthly uptime. Maximum 43.8 minutes of downtime per month.
Enterprise: 99.99% monthly uptime. Maximum 4.38 minutes of downtime per month. Custom SLAs available.

Uptime is measured as the percentage of time the core evaluation API is available during a calendar month, excluding scheduled maintenance windows (announced at least 48 hours in advance).

If we fail to meet the applicable SLA, you may be eligible for service credits as described in your plan agreement. Service credits are your sole and exclusive remedy for downtime.

9.حدود المسؤولية

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

No Indirect Damages: Qawaid shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the cause of action or theory of liability.
Cap on Liability: Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to Qawaid in the twelve (12) months preceding the claim.
No Warranty on Evaluations: While we strive for accuracy, Qawaid does not guarantee that rule evaluations will be error-free. You are responsible for testing and validating rules before deploying them in production.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet disruptions, or third-party service failures.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10.الإنهاء

Either party may terminate the relationship as follows:

By You: You may cancel your subscription and close your account at any time through your account settings. Monthly subscriptions terminate at the end of the current billing period. Annual subscriptions may be eligible for a prorated refund as described in Section 4.
By Us: We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a risk to the Service or other users. We will provide notice where practicable.
Effect of Termination: Upon termination, your access to the Service will cease. Customer Data will be available for export for 30 days following termination, after which it will be permanently deleted.
Survival: Sections relating to intellectual property, limitation of liability, data ownership, and governing law shall survive termination.

11.القانون الحاكم

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration under the rules of the Dubai International Arbitration Centre (DIAC), except that either party may seek injunctive relief in a court of competent jurisdiction.

The arbitration shall be conducted in Dubai, UAE. The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

For users in the European Union, nothing in this section shall deprive you of the protection of mandatory consumer protection laws in your country of residence.

12.التغييرات على الشروط

We reserve the right to modify these Terms at any time. When we make material changes:

We will notify you via email and/or an in-app notification at least 30 days before the changes take effect.
We will post the revised Terms on this page with an updated "Last Updated" date.
A summary of changes will be provided for your convenience.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and close your account before the changes take effect.
